If Virtanen did something, its an accusation without witnesses and no criminal charges. You don't have to have actual damages to file a civil lawsuit. People make foolish claims and accusations daily and then go on to lose big in the courts. Attorneys dont work for free. What Mailloux did was criminal and he admitted to it?

Its a civil matter, not criminal and in the US he is innocent until proven guilty. The article I read also that the Gov't has not filed any charges and nothing has been filed with the courts.
